TERMS AND CONDITIONS
The buyer can be a natural or legal person, taking into account the information provided when placing the order. A natural person is exclusively the customer who obtains or uses goods and services for purposes outside his professional or gainful activity.
By submitting a request, the buyer confirms that he accepts the general terms and conditions posted on this site and other published terms and conditions and the changes that the manager will publish on these pages.
Gamat d.o.o. and the buyer are governed by their mutual obligations under these General Terms and Conditions and the Consumer Protection Act.
The buyer is bound by the general terms and conditions at the time of placing the order (online purchase).
In the case of a classic purchase, the buyer is obliged to place orders by email or with a company order form.
PRICES OF ARTICLES
All product prices are in EUR and include value-added tax (VAT). Each item is marked with a price without tax and with tax. Tax is 22% (Slovenian regular tax).
When you chose your country – the tax will be changed in tax of your country.

Price: is the regular price at which the item is sold.
Special Price: Reduced regular price at which an item is sold for a fixed or indefinite period.
LABELING OF DISCOUNTS
Discounted: marked products that are currently in a campaign that is limited in time.
Last Pieces: Items that have a reduced price for an indefinite period of time, or until the stock is sold.
Outlet: These are products that are currently on sale and may be out of time. It may apply until the stock is sold. Items with the OUTLET label are available in limited quantities (usually the last piece/pair available) and the discounted price is only valid for the marked Outlet items.
Mediated prices are subject to change without notice. Individual items are subject to prices at the time of demand, except in the event of a price error. In spite of the constant verification of the correctness of the data, the price may be wrong. We will notify the buyer of the error as soon as possible (via email or telephone) and will try to find a solution to our mutual satisfaction.
The purchase contract between the buyer and the bidder is concluded when the buyer pays the amount of the invoice/order received, or in special cases when he signs the delivery note for the goods received. The buyer receives the invoice containing the specification of the amount in a shipment or separately by mail.
ORDER CANCELLATION - FROM BUYER
The buyer can cancel the order within 1 hour after placing the order at no cost. When canceling an order, you must provide the first and last name and order number.
REFUSAL OF THE ORDER - BY THE SELLER
Gamat d.o.o. the contract which it finds cannot be executed under the specified conditions may be rejected. It may also reject orders it deems suspicious.
Likewise, Gamat d.o.o. rejects online orders over 1,000 euros and requires the buyer to send the order form for the desired goods, especially for custom-made goods. This protects against the possible return of goods by the buyer for personalized products.
RETURN OF GOODS
Natural persons who conclude a contract/distance purchase (via an online store) in accordance with the Consumer Protection Act, have the right to announce within 14 days from the receipt of the goods at the info@gamat-shop.com address that they withdraw from the contract/purchase, without having to give a reason for their decision. The announcement must be in writing via e-mail (info@gamat-shop.com ) and with the attached cancellation form.
In the event that the buyer withdraws from the contract/purchase with a message on info@gamat-shop.com , he must return the received goods to our address within 14 days after the message. Gamat d.o.o. will transfer the amount of payment received for the returned goods to the buyer in his bank account as soon as possible, or. no later than 14 days after receipt of the returned goods.
If the buyer starts using the product and changes his mind, he loses the right to withdraw from the contract/purchase.
Also, it must return the received goods undamaged, in the same quantity and with the original packaging undamaged, unless the goods are destroyed, defective, lost or their quantity reduced without the buyer's fault (It should also be noted that the conclusion The distance contract does not give the consumer more rights than otherwise concluding the contract in the traditional way (that is, by visiting the store).
The cost of returning the goods is paid by the buyer.
Items that cannot be returned by mail due to their nature are picked up at the seller's request by a delivery service designated by the seller. The cost of returning the items is borne by the buyer.

If the contract is executed by a legal or natural person engaged in gainful activity, irrespective of its legal form or ownership, and in cases where the purchase is not made on the basis of a distance contract, the provisions of the preceding paragraph shall not apply. In these and similar cases, any requests for the return of goods will be considered individually, taking into account to the fullest extent possible all the reasons and circumstances.
Return of damaged shipments
In the event that the package is damaged, lacks content or shows signs of opening, the buyer must initiate a complaint procedure with the supplier of goods (GLS). Together we will make sure that the complaint is resolved as soon as possible.
RECLAMATION AND WARRANTY
If the goods do not have the properties that the seller has explicitly promised, if the seller has sent the wrong products, in the wrong quantity, color or the goods otherwise deviate from the buyer's order, then the buyer advertises the goods. Upon prior agreement with the seller, the goods can also be returned by post, otherwise, you personally bring them to the Ljubljana branch.

Products purchased at a distance are subject to all warranty terms in accordance with Slovenian law. The guarantee can only be claimed upon submission of the invoice. The guarantee can be claimed at the company headquarters.
The defect on the product can be advertised by the consumer under the warranty or from a defect in accordance with the Consumer Protection Act (ZVPot). The consumer can claim the warranty for the products for which the warranty is obligatory (the list of these products is determined by the Regulations on goods for which the guarantee of faultless operation is issued) and for those for which a voluntary guarantee has been given. However, consumer complaints can be claimed for every product purchased (which means that due to a defect in a product for which no warranty has been given, the consumer can claim rights from a material error, and the same can be decided if he does not want to claim warranties for the product for which the guarantee was given).
On the basis of the guarantee, the consumer may, within the warranty period, request from the guarantor (the manufacturer or his agent, importer or seller) a defect-free of charge. If the error cannot be corrected or the company fails to correct it within a total of 45 days, the consumer may request a replacement for a new free product.
However, due to a real defect, the consumer can claim a defect in the product by the seller within two months from the discovery of the real defect (for defects that appear on the goods after two years from the receipt, the seller no longer is responsible) and at his own request:
- debugging or
- a refund of the amount paid in proportion to the error or
- exchange of goods or
- repayment of the amount paid.
The ZVPot error is real:
- if the goods do not have the characteristics necessary for their normal use or circulation;
- if the goods do not have the characteristics necessary for the specific use for which the buyer purchases it, which the seller knew or should have known;
- if the goods do not have the characteristics and qualities that have been explicitly or tacitly agreed upon or prescribed;
- if the seller has delivered goods that do not match the sample or model unless the sample or model has been shown for information only.
- If the defect is not disputed, the company must comply with the consumer's request as soon as possible and at the latest within eight days. If there is a dispute about the error, the company must provide the consumer with a written response within the same deadline.
SHIPPING AND DELIVERY TIMES
Delivery time: As our sales range is very wide, unfortunately, we cannot provide all the items in stock. If your ordered goods are not in stock in our warehouse, we will order it from our supplier and send it to your address as soon as possible.
The approximate delivery time of each item is indicated on the individual item, written above the price ("delivery time"). We will do our best to have it delivered to your address within the written time, but unfortunately, we cannot guarantee the exact delivery time, as it depends on the stock at the supplier.
Delivery of the order will be made within 2 to 5 days from the order submission in case of payment upon receipt or immediate payment by bank card/ Paypal, and in the case of payment by proforma invoice, within 2 to 5 working days from the date of receipt of payment to our account. (provided the goods are in stock in our warehouse).
In case the stock goes out, we will inform you immediately and present you the rest of the offer or let you know the delivery time for the ordered items.
In case of special requests, please enter them under the "notes" at the bottom of the order. Delivery is effected to your address, which you provided at check-in or order. In case you are away from home at the time of delivery, the supplier will arrange for you to resend, at no additional cost.
Delivery of ordered goods is performed by our contractual partner GLS.

In the case of bank transfer, upon confirmation of the order, the buyer receives a proforma invoice by e-mail, and the goods are shipped to the buyer upon receipt of the payment or the receipt of funds to the seller's account (provided that the goods are in stock or as soon as we receive the goods in storage) .

COMPLAINTS AND DISPUTES
Provider Gamat d.o.o. complies with applicable consumer protection legislation. The Bidder must confirm within 5 working days that it has received the complaint and inform the buyer of the progress of the procedure. The Bidder is aware that an essential feature of a consumer dispute, at least as far as litigation is concerned, is its disproportionate effect on the economic value of the claim and the costs involved in resolving the dispute itself. This is also a major obstacle to the consumer from bringing a dispute to court. Therefore, the provider is doing his best to resolve any disputes by mutual agreement.

Out-of-court settlement of consumer disputes
In accordance with the legal norms of Gamat d.o.o. does not recognize any out-of-court consumer dispute resolution contractor as competent to settle a consumer dispute that could be brought by the consumer under the Out-of-Court Consumer Dispute Resolution Act.
